Employment Law Audits

An employment practices audit undertaken at the direction of employment law counsel is a powerful preventive tool.

It is structured to:

  • analyze employment law compliance and risks;
  • identify - - and prioritize - - action items to achieve compliance;
  • recommend loss control and risk management mechanisms (for example, decision-making protocols, implementation of personnel policies/practices) for dealing with particular employment-related risks;
  • position employers to take advantage of legal defenses in the event of lawsuits or governmental audits; and
  • to the extent available, shield the results of the audit from disclosure in the event of lawsuits or governmental audits under the doctrine of attorney-client privilege, a protection that is not available if the audit is conducted by an employer's Human Resources department or a Human Resource consultant.
